Terms of Service

1. Description of Service

HostFlow is a short-term rental management tool for individual property hosts. It syncs booking calendars (via iCal feeds), tracks booking changes, manages team members (cleaners, co-hosts), and automates notifications via email (Gmail), Slack, and Telegram. The Service is provided on a hosted, software-as-a-service basis.

2. Eligibility and Account Registration

You must be at least 18 years old and capable of entering into a binding agreement to use the Service. By registering, you represent that the information you provide is accurate and complete. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at hello@hostflow-app.us if you suspect unauthorised access.

You may not create accounts for the purpose of abuse, scraping, or circumventing restrictions.

3. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Send unsolicited, misleading, or spam messages through HostFlow's notification features.
• Attempt to gain unauthorised access to any part of the Service, its servers, or other accounts.
• Reverse-engineer, decompile, or disassemble the Service.
• Use the Service to store or transmit malicious code.
• Resell or sublicense the Service without our express written permission.
• Harvest or scrape data from the Service in an automated manner without our consent.

We reserve the right to suspend or terminate accounts that violate these rules.

4. Third-Party Integrations

The Service integrates with third-party platforms — including Google (Gmail), Slack, Telegram, Airbnb (via iCal), and Supabase — to provide its features. Your use of those platforms is governed by their respective terms and privacy policies. We are not responsible for the availability, accuracy, or conduct of any third-party service.

When you connect your Gmail account, you grant HostFlow permission to send emails on your behalf using the Google Gmail API. HostFlow will use this access solely to send the notification emails you configure within the Service. You can revoke this permission at any time from your Google Account security settings or from within HostFlow.

HostFlow's use of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.

5. Your Content and Data

You retain ownership of all data you input into the Service (listings, booking data, team member information, message templates, photos). By using the Service, you grant us a limited, non-exclusive licence to store and process that data solely to provide the Service to you.

You are responsible for ensuring you have the right to share any data you provide, including personal information about your team members. You must obtain any required consent from team members whose contact details you enter.

6. Intellectual Property

HostFlow and its original content, features, and functionality are and remain the exclusive property of HostFlow. Nothing in these Terms transfers any intellectual property rights to you. The HostFlow name, logo, and product design are protected and may not be used without our prior written consent.

7. Privacy

Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

8. Service Availability and Changes

We aim to provide a reliable service but do not guarantee uninterrupted or error-free availability. We may modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will make reasonable efforts to notify you in advance of material changes.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR THAT NOTIFICATIONS WILL BE DELIVERED ON TIME OR AT ALL.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HOSTFLOW AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT WILL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR US $100 IF YOU HAVE NOT PAID ANY FEES.

11. Indemnification

You agree to indemnify, defend, and hold harmless HostFlow and its operators from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

You may stop using the Service and delete your account at any time by contacting hello@hostflow-app.us. We may suspend or terminate your access if you breach these Terms or if we discontinue the Service, with reasonable notice where practicable. Upon termination, your right to use the Service ceases and we will handle your data as described in the Privacy Policy.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions. Any disputes arising under these Terms shall be resolved in a court of competent jurisdiction.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or via an in-app notice and update the effective date above. Continued use of the Service after the effective date constitutes your acceptance of the revised Terms.
